1. Agreement to Terms

These Terms and Conditions (hereinafter "Terms") govern your access to and use of the yeswin online gaming platform, including all associated websites, mobile applications, and services (collectively, the "Platform"). By registering an account, accessing the Platform, or using any yeswin services, you enter into a binding legal agreement with yeswin and agree to comply with all provisions set forth in these Terms.

3. Account Registration and Security

3.1 Account Creation

To access yeswin gaming services, you must register for an account by providing accurate personal information including, but not limited to, your full legal name, date of birth, valid email address, mobile phone number, and residential address in the Philippines. You may only register one account with yeswin. Multiple accounts registered by the same person are strictly prohibited.

3.2 Account Credentials

You are responsible for maintaining the confidentiality of your account username and password. You must not share your login credentials with any third party. All activity conducted through your account is your responsibility, whether or not authorized by you. You must notify yeswin immediately upon discovering any unauthorized use of your account or any other security breach.

3.3 Account Verification

yeswin reserves the right to request verification documents at any time, including but not limited to government-issued identification, proof of address, and proof of payment method ownership. You must provide requested documents within seven (7) days. Failure to comply may result in account restrictions, including suspension of deposits, gaming activity, and withdrawals until verification is satisfactorily completed.

3.4 Accurate Information

You warrant that all information provided to yeswin during registration and subsequently is true, accurate, current, and complete. You agree to update your information promptly when changes occur. Providing false, inaccurate, or misleading information constitutes a material breach of these Terms and may result in immediate account termination and forfeiture of all funds.

4. Deposits and Withdrawals

4.1 Deposits

You may fund your yeswin account using approved payment methods displayed on the Platform, including GCash, Maya, bank transfers, and other payment services available in the Philippines. All deposits are subject to minimum and maximum limits as specified on the Platform. yeswin reserves the right to refuse any deposit or impose additional verification requirements before accepting deposits.

Deposited funds are intended for gaming purposes only. yeswin is not a financial institution and does not pay interest on account balances. You must not use yeswin as a banking or money transfer service.

4.2 Withdrawals

Withdrawals must be made to a payment method registered in your own name. yeswin reserves the right to request additional verification before processing withdrawal requests.

4.3 Fees and Currency

All transactions on yeswin are conducted in Philippine Peso (PHP). Currency conversion, if applicable, occurs at your payment provider's exchange rate.

4.4 Anti-Money Laundering

yeswin is committed to preventing money laundering and terrorist financing. All deposits must be wagered at least once before withdrawal. yeswin reserves the right to request source of funds documentation and to report suspicious transactions to relevant Philippine authorities in accordance with Anti-Money Laundering Council (AMLC) regulations.

5. Gaming Rules and Conduct

5.1 Game Participation

All gaming activities on yeswin must be conducted in good faith and in accordance with the rules of each individual game. 5.2 Fair Play

yeswin operates all games fairly using certified random number generators (RNGs) tested by independent auditors. You agree to participate in games honestly without employing fraudulent strategies, exploiting software vulnerabilities, or colluding with other players. Any form of cheating, fraud, or manipulation is strictly prohibited and will result in immediate account termination and fund forfeiture.

5.3 Technical Issues

While yeswin strives to maintain optimal Platform performance, technical issues may occasionally occur. In the event of system malfunction, technical error, or game interruption, yeswin reserves the right to void affected bets and refund stakes. yeswin's liability in such circumstances is limited to refunding the affected stake amounts; no additional compensation shall be provided.

5.4 Game Results

All game results are final once the outcome is determined by the RNG or, in the case of live dealer games, once the dealer declares the result. Bets cannot be changed, cancelled, or reversed after placement except in cases of obvious technical error or as specified in individual game rules. Disputes regarding game outcomes must be reported to yeswin customer support within 7 days of the disputed game session.

All content, features, and functionality on the yeswin Platform, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (collectively, "Content"), are the exclusive property of yeswin or its licensors and are protected by Philippine and international copyright, trademark, patent, trade secret, and other intellectual property laws.

The yeswin name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of yeswin. You must not use such marks without the prior written permission of yeswin. All other names, logos, product and service names, designs, and slogans on the Platform are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable license to access and use the Platform and Content for personal, non-commercial gaming purposes only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Content except as incidentally required for normal use of the Platform or as expressly permitted in these Terms.

8. Prohibited Activities

When using yeswin services, you agree not to engage in any of the following prohibited activities:

• Using the Platform for any unlawful purpose or in violation of these Terms or applicable Philippine laws and regulations.
• Attempting to gain unauthorized access to any portion of the Platform, other user accounts, or any systems or networks connected to the Platform.
• Using automated scripts, bots, spiders, scrapers, or other automated means to access the Platform or extract data.
• Interfering with or disrupting the integrity or performance of the Platform or attempting to gain unauthorized access to the Platform's underlying systems or networks.

• Using the Platform to launder money or engage in other financial crimes.
• Colluding with other players or employees to gain unfair advantage in games.

• Reverse engineering, decompiling, or disassembling any software used in connection with the Platform.

• Sharing your account credentials or allowing others to use your account.

Violation of any prohibited activity may result in immediate account suspension or termination, forfeiture of funds, and potential legal action. yeswin reserves the right to report illegal activities to appropriate law enforcement authorities.

9. Account Suspension and Termination

9.1 yeswin's Right to Suspend or Terminate

yeswin reserves the right to suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms; provision of false or misleading information; fraudulent or illegal activity; suspicious betting patterns; failure to provide requested verification documents; inactivity for an extended period; or at yeswin's sole discretion.

9.2 Effect of Termination

Upon termination or suspension of your account, your right to access and use yeswin services immediately ceases. yeswin will process withdrawal of any remaining balance in accordance with these Terms, provided you are not in breach and funds are not subject to investigation. However, yeswin reserves the right to withhold funds where fraud, breach of terms, or illegal activity is suspected pending investigation and resolution.

9.3 Your Right to Close Account

You may close your yeswin account at any time by contacting customer support. You remain responsible for all activity on your account up to the date of closure. Any unused bonus funds will be forfeited upon voluntary account closure. Closure does not affect any obligations or liabilities incurred prior to closure.

9.4 Inactive Accounts

Accounts with no login activity for twelve (12) consecutive months may be deemed inactive. yeswin reserves the right to charge an administrative fee on inactive accounts. If your account remains inactive for twenty-four (24) months, yeswin may close the account and forfeit any remaining balance in accordance with Philippine law.

10. Limitation of Liability

To the maximum extent permitted by Philippine law, yeswin and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of opportunity, or business interruption, arising out of or in connection with your use of yeswin services, whether based on warranty, contract, tort, or any other legal theory, and whether or not yeswin has been informed of the possibility of such damage.

yeswin's total liability to you for all claims arising out of or relating to these Terms or your use of yeswin services shall not exceed the amount deposited into your account during the six (6) month period immediately preceding the event giving rise to liability, or One Thousand Philippine Pesos (PHP 1,000), whichever is less.

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. yeswin does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

You acknowledge that gambling involves financial risk and that you may lose money. yeswin is not responsible for any gambling losses incurred through use of the Platform. You are solely responsible for managing your gambling activities and should only wager what you can afford to lose.

11. Dispute Resolution

11.1 Customer Support

If you have any concerns, complaints, or disputes regarding yeswin services, you must first contact our customer support team through live chat, email, or phone. yeswin will make reasonable efforts to resolve disputes amicably within thirty (30) days of notification.

11.2 Formal Complaint Process

If your dispute is not resolved through customer support, you may submit a formal written complaint detailing the nature of the dispute, relevant facts, and desired resolution. yeswin will investigate the complaint and provide a written response within fourteen (14) business days. All decisions made by yeswin in resolving disputes shall be final and binding.

11.3 Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or your use of yeswin services that cannot be resolved through the complaint process shall be settled by binding arbitration in accordance with the rules of the Philippine Dispute Resolution Center, Inc. (PDRCI). The arbitration shall be conducted in English in Manila, Philippines. The decision of the arbitrator shall be final and binding on both parties.

11.4 Class Action Waiver

To the extent permitted by Philippine law, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against yeswin.

12. Amendments to Terms

yeswin reserves the right to modify, amend, or update these Terms at any time without prior notice. Changes become effective immediately upon posting on the Platform. Continued use of yeswin services after changes are posted constitutes acceptance of the modified Terms.

Material changes to these Terms will be communicated through email notification to your registered email address or through prominent notice on the Platform. It is your responsibility to review these Terms periodically for updates. If you do not agree with any changes, you must immediately cease using yeswin services and close your account.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of yeswin services shall be brought exclusively in the courts of Manila, Philippines, and you consent to the personal jurisdiction of such courts.

yeswin operates in compliance with Philippine gaming regulations and applicable laws. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
